According to a Caring.com survey, only 42% of U.S. adults currently have estate planning documents such as a will or living trust. Estate planning is becoming less prevalent overall: the number of adult Americans who have a will or other type of estate planning document decreased by nearly 25% since 2017.

It's important to have a will because if you don’t have one, the state will determine who gets your belongings, according to applicable law. This process is called intestate succession and it's what happens when someone dies without a valid will in place.

Yes, the forms included in the Legacy Will Kit® are templates and forms which have been provided to assist you with the preparation of legally recognized estate planning documents. However, the Legacy Will Kit® is not a substitute for legal advice from a licensed attorney.

Remember that individual situations and estate planning needs are unique, so we recommend you contact an attorney to review your will and any other estate planning documents that you prepare to make sure they are applicable to State law and appropriately reflect your intentions.

No. The Legacy Will Kit® is provided to you free of charge.

A licensed insurance agent will deliver all of the documentation either in person or electronically, but you may find the following preparation tips useful:

  • Create a list of personal items and tangible personal property you want to leave to your loved ones.
  • If you’re including a loved one at another residence in your Legacy Will Kit®, you’ll want to have their mailing address nearby to reference.
  • You should sign your will in the presence of a notary public and at least two witnesses. The witnesses and notary public much watch you sign your will and must sign your will in your presence. The witnesses should not be related to you by blood, adoption, or marriage, nor should they be beneficiaries under your will. You and the witnesses should provide identification such as a driver's license to the notary public.
